These Terms of Use (“Terms”) govern your access to and use of the ClearCheck websites and the ClearCheck reporting dashboard (the “Service”).

Operator: DATA FACTORY LTD (HE 478941), a private limited company registered in Cyprus (“Company”, “we”, “us”, “our”).

By creating an account, purchasing a package, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1) The Service

ClearCheck provides a paid, web-based platform that allows customers to generate and download employment background check reports through the dashboard.

2) Eligibility and Accounts

You must be at least 18 years old to use the Service.

You agree to:

• provide accurate account and billing information,

• keep your login credentials secure,

• be responsible for all activity under your account.

3) Customer Responsibilities

You are responsible for:

• ensuring you have the right to submit the information you enter into the Service,

• using the Service only for lawful, employment-related purposes,

• following any required notices, authorizations, and procedures required by applicable law.

You are solely responsible for hiring decisions and actions taken based on reports.

4) Payments, Packages, and Credits

ClearCheck is a paid Service. Packages, pricing, and credit usage rules are shown on the Site and during checkout.

Unless otherwise stated:

• all fees are non-refundable after delivery of report access or report generation,

• subscription credits (if applicable) follow the billing cycle rules shown at purchase,

• credits have no cash value outside the Service.

Payments are processed by a third-party payment provider. We do not store full payment card details.

5) Acceptable Use

You may not:

• share, resell, sublicense, or transfer your access to the Service,

• attempt to bypass security controls or access areas you are not authorized to access,

• interfere with the Service or attempt to disrupt normal operation,

• use the Service in a way that violates applicable law.

We may suspend or terminate accounts for misuse or violations.

6) Reports and Disclaimers

Reports are provided “as is” and may not be complete or error-free. Data availability may vary by jurisdiction and source.

We do not guarantee that any report will include specific records or outcomes. You are responsible for reviewing reports and confirming information before relying on it.

7) Intellectual Property

The Service, including the website, dashboard, report formats, and branding, is owned by the Company or its licensors and is protected by applicable intellectual property laws.

You may not copy, modify, or create derivative works from the Service except as permitted by these Terms.

8) Limitation of Liability

To the maximum extent permitted by law:

• we are not liable for indirect, incidental, special, consequential, or punitive damages,

• our total liability for any claim relating to the Service will not exceed the amount you paid to us in the 3 months before the event giving rise to the claim.

9) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.

10) Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new “Last updated” date. Continued use of the Service means you accept the updated Terms.

11) Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Cyprus.
