These Terms of Use (“Terms”) govern your access to and use of the ClearCheck websites and the ClearCheck reporting dashboard (the “Service”).

Operator: CLEARCHECK LTD (HE 478941), a private limited company registered in Cyprus (“Company”, “we”, “us”, “our”).

By creating an account, purchasing a package, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1) The Service

ClearCheck provides a paid, web-based platform that enables users to generate and access informational reports based on data derived from public and third-party sources.

The Service is intended solely for general informational and decision-support purposes.

ClearCheck does not provide employment screening, tenant screening, credit reporting, or other regulated consumer reporting services.

2) Eligibility and Accounts

You must be at least 18 years old to use the Service.

You agree to:

Provide accurate account and billing information,
Keep your login credentials secure,
Be responsible for all activity under your account.

You agree to use the Service only for lawful and non-regulated purposes in accordance with these Terms.

3) Customer Responsibilities

You are solely responsible for:

Ensuring that you have the legal right to submit any information into the Service
Ensuring that your use of the Service complies with all applicable laws and regulations
Verifying the accuracy and relevance of any information obtained through the Service

You acknowledge and agree that:

The Service provides informational content only
ClearCheck does not make decisions or recommendations about individuals
You are solely responsible for any actions taken based on information obtained through the Service

You agree that you will not use the Service:

For employment decisions
For tenant screening
For credit eligibility
For insurance underwriting
For any purpose governed by the Fair Credit Reporting Act (FCRA) or similar laws

4) Payments, Packages, and Credits

ClearCheck is a paid Service. Packages, pricing, and credit usage rules are shown on the Site and during checkout.

Unless otherwise stated:

all fees are non-refundable after delivery of report access or report generation,
subscription credits (if applicable) follow the billing cycle rules shown at purchase,
credits have no cash value outside the Service.

Payments are processed by a third-party payment provider. We do not store full payment card details.

5) Acceptable Use

You may not:

Share, resell, sublicense, or transfer your access to the Service,
Attempt to bypass security controls or access areas you are not authorized to access,
Interfere with the Service or attempt to disrupt normal operation,
Use the Service in a way that violates applicable law.

We may suspend or terminate accounts for misuse or violations.

You may not use the Service in any manner that implies it is a consumer reporting agency or that the reports provided are consumer reports under applicable law.

6) Reports and Disclaimers

All reports are provided on an “as is” and “as available” basis.

ClearCheck does not guarantee that any report will be complete, accurate, or up to date.

Information included in reports is derived from public and third-party sources and may vary by jurisdiction and availability.

Reports are provided for informational purposes only and:

Do not constitute recommendations
Do not constitute verification of identity
Do not constitute eligibility determinations

Users are responsible for independently reviewing and verifying any information before relying on it.

ClearCheck is not a consumer reporting agency and does not provide “consumer reports” as defined under the Fair Credit Reporting Act (FCRA).

7) Intellectual Property

The Service, including the website, dashboard, report formats, and branding, is owned by the Company or its licensors and is protected by applicable intellectual property laws.

You may not copy, modify, or create derivative works from the Service except as permitted by these Terms.

8) Limitation of Liability

To the maximum extent permitted by law:

we are not liable for indirect, incidental, special, consequential, or punitive damages,
our total liability for any claim relating to the Service will not exceed the amount you paid to us in the 3 months before the event giving rise to the claim.

ClearCheck shall not be liable for any decisions made or actions taken by users based on information obtained through the Service.

9) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.

10) Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new “Last updated” date. Continued use of the Service means you accept the updated Terms.

11) Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Cyprus.
